Course overview

The Practical Implications of the National Credit Act course provides you with a comprehensive overview of the National Credit Act 34 of 2005 and its subsequent amendments (and practical implications) affected by the National Credit Amendment Act 19 of 2014. During the course, you will gain requisite insights to recent court decisions and relevant legal publications relating to the Act, and specifically, its impact on legal practitioners and other role players in the consumer credit industry. The course will also enable you to identify unlawful agreements and/or provisions in credit agreements in order to determine authoritative non-compliance to the Act.

  • Attorneys, advocates, debt collectors, credit providers, debt counsellors and others involved in consumer credit will benefit from attending this workshop.

Course objectives

At the end of this course, Participants will be able:

  • Understand and apply the main provisions of the Act and the Amendment Act with reference to applicability of the Act to credit agreements; registration requirements for credit providers and the consequences of failure to register.
  • Gain insight into issues of over-indebtedness and the debt counseling process; reckless credit and affordability assessments; and debt collection under the Act.
  • Grasp a deeper understanding of unlawful agreements and unlawful provisions in credit agreements as well as the sanctions in case of non-compliance to the Act.
